Terms and Conditions for BYO Event Space - Hall of Fame

These terms and conditions ("Terms") constitute an agreement between the event organizer or renter ("You" or "Your") and Hall of Fame, the provider of the BYO event space ("We," "Us," or "Our"). By utilizing the Hall of Fame event space ("Event Space"), You agree to comply with these Terms. Please read them carefully.

Reservation and Payment:

a. Reservation: To secure the Event Space, You must make a reservation in advance by contacting Us through the designated channels. Reservations are subject to availability.

Payment: The event hire payment is to be paid in full on booking of the event as agreed upon. Payment methods and details will be provided in the reservation agreement.

A booking will be held with 100% payment of the event hire fee and the supply of credit card details.

A security bond of $500 will be charged at checkout. This is refundable should no damage occur or use of the venue past 2.30am

Use of Event Space:

a. Permitted Use: The Event Space is to be used solely for the purposes agreed upon and specified in the reservation agreement. Any changes to the intended use must be approved by Us in writing.

b. Compliance with Laws: You must comply with all applicable laws, regulations, and permits while using the Event Space. This includes, but is not limited to, fire safety, health, and noise regulations. You are responsible for obtaining any necessary permits or licenses required for Your event.

c. Care and Damage: You are responsible for the care and protection of the Event Space and any equipment or property within it. Any damage caused to the Event Space or its contents by You or Your guests will be Your financial responsibility. We reserve the right to assess damages and seek compensation for any repairs or replacements required.

Liability and Insurance:

a. Liability: We shall not be held liable for any injury, loss, damage, or theft of property that occurs within the Event Space, except in cases of gross negligence or willful misconduct on Our part. You and Your guests enter and use the Event Space at Your own risk.

b. Insurance: We strongly recommend that You obtain appropriate liability insurance coverage for Your event. This includes personal injury, property damage, and third-party liability insurance. You are responsible for ensuring that You and Your guests are adequately covered by insurance.

BYO Policy:

a. Alcohol and Food: You are permitted to bring Your own alcoholic beverages and food to the Event Space, as this is a private party /event - subject to any applicable laws and regulations. You must ensure responsible alcohol consumption and the lawful service of alcohol. Minors must not be served alcohol.Alcohol and Smoking

Alcohol service and consumption is permitted in accordance with the “Responsible Service of Alcohol Act”. The sale of liquor without a suitable licence is illegal and therefore strictly prohibited in the venue. No alcohol is to be consumed outside the venue.

Smoking is NOT permitted inside the venue however a designated smoking area is available in the outside courtyard.

b. Safety and Cleanliness: You are responsible for ensuring the safe handling, serving, and disposal of food and beverages. All applicable health and safety guidelines must be followed. You must leave the Event Space clean and free of any debris or waste generated during Your event. Failure to do so may result in additional cleaning charges.

c. Compliance: You must comply with all relevant laws, regulations, and permits relating to the consumption and service of alcohol and food.

Indemnification:

You agree to indemnify, defend, and hold Us harmless from any claims, liabilities, damages, costs, and expenses arising out of or related to Your use of the Event Space. This includes but is not limited to personal injury, property damage, or any violation of these Terms. You are solely responsible for the actions and conduct of Your guests.

Cancellation and Refunds:

a. Cancellation: If You need to cancel Your reservation, You must provide written notice within a specified timeframe as stated. Notification of cancellations will only be accepted in writing.

Notifications of cancellation 60 days in advance incur a full refund less a $200 +GST administration fee.

Notifications of cancellation 30-60 days in advance incur a penalty of 50% of event fees.

Notifications under 30 days incur a 100% loss of full payment. Should the venue be able to re-sell your original date, the venue hire fee can be transferred to another date, if the venue is available and agreed to by Hall of Fame, but the event must be held within 6 months of the original event date.

Venue Access

The Hirer may access the venue from 2pm on the day of the booking and shall ensure that all guests vacate the venue by the agreed time. The Hirer is responsible for the set-up and pack-down of the event. Bump Out is at the conclusion of the party. Access beyond 2.30am incurs a surcharge of $150 per hour or part thereof. Specific arrangements to extend must be confirmed by the Venue Manager in writing.

Hirer’s Pack Up Checklist

All decorations have been removed (including balloons, tape and adhesives, streamers, etc)

Toilets have been left in a reasonable state and tidied of excessive rubbish

All rubbish has been placed in external rubbish hopper bins to capacity only, or removed from the premises

All tables and chairs are returned to the original position

All additional items belonging to the hirer are removed from the venue (including food and drinks, music equipment etc).

All heating/air-conditioning have been turned off

Turn Power off to AV Equipment

All lights are turned off

All doors (Roller Door and Front Gate door) are locked and secured
